Terms of Use

This website at penandinc.sg (the “Site”) is operated by Niharika Pte Ltd and its affiliates (the “Company”, “we” or “us”). By accessing or using the Site you agree to be bound by these Terms of Use as if you had signed a written agreement, and you represent that you are of legal age to form a binding agreement under the laws of Singapore or any other relevant jurisdiction. If you do not agree, please do not use the Site.
Changes to these terms
We may revise these Terms at any time at our sole discretion and without prior notice. The latest version is posted here, and your continued use of the Site constitutes acceptance of the then-current version.
Intellectual property
All content on the Site — including the visual interface, interactive features, graphics, designs, photography, videos, compilations, translations and digital conversions (the “Intellectual Property”) — is owned by the Company, its licensors or third parties, and is protected by Singapore law and international conventions. The typefaces used on this Site are licensed to the Company and may not be extracted or reused.
Limited licence
You are granted a limited, non-exclusive, non-transferable licence to access and view the Site for your personal, non-commercial use. You may not republish, distribute, modify, create derivative works from, or otherwise exploit any content without our prior written consent.
Reservations, orders and events
- A reservation request is confirmed only when we confirm it. Tables are held for a reasonable period; we may release a table that is not claimed.
- Menu items, prices and availability may change without notice. Prices are in Singapore dollars and are subject to service charge and prevailing GST unless stated otherwise.
- Direct delivery orders are placed with our one-north kitchen on WhatsApp and are confirmed by us, with prices and payment agreed before we cook. If you order through a third-party delivery platform instead, that order is a contract with the platform and is governed by its terms.
- PEN & INC does not issue its own gift vouchers. Vouchers redeemable at PEN & INC are issued by CALI and governed by the terms published at cali.sg/voucher.
- Event and function bookings are subject to a separate written agreement, including deposit and cancellation terms.
Allergens and dietary information
We prepare food in kitchens that handle a wide range of ingredients, so we cannot guarantee that any dish is entirely free from a given allergen. Dietary labels on this Site are a guide. If you have an allergy or intolerance, please tell our team before you order.
Security and use
The Site may include features designed to protect its digital content. You agree not to attempt to circumvent or override them. Unauthorised reproduction, publication or distribution of Site materials is prohibited.
Monitoring and disclosures
We reserve the right to monitor and disclose information relating to your use of the Site as required by law, regulation or legal process.
Disclaimer of warranties
YOUR USE OF THE SITE IS AT YOUR SOLE RISK. THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY OF THE SITE’S CONTENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS AFFILIATES, SUBSIDIARIES, SUCCESSORS, ASSIGNS, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS OR DATA) ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Your sole remedy is to discontinue using the Site.
Indemnification
You agree to indemnify and hold harmless the Company and the parties named above from any claims, damages or expenses (including reasonable legal fees) arising from your use of the Site or your violation of these Terms.
Assignment
We may assign or transfer these Terms, in whole or in part, without notice. You may not assign your rights under these Terms without our prior written consent.
Third-party sites
The Site contains links to third-party websites. We do not control them and are not responsible for their content or practices. Your use of them is at your own risk.
Governing law
These Terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any claim relating to the Site.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and the Company regarding your use of the Site and supersede any prior agreements or communications.

Each brand is governed by these documents together with any additional policies published for that brand.
